Court / Court round up – 23 November 2022

BEHAVING in a threatening manner and verbally abusing a female acquaintance in the newly open Trench nightclub earlier this month has cost a Glasgow man more than £800 in fines.

Lerwick Sheriff Court heard on Wednesday that Peter McLean repeatedly approached and verbally abused the off-duty police officer who he knew from a previous posting elsewhere.

Defending himself, McLean, of Elengowan Crescent, Milngavie, said he was embarrassed having to appear in court as a result of his behaviour.

He said he was usually employed offshore laying subsea cables, but on this occasion he found himself in Shetland where the company he is working for had work to do.

Sheriff Ian Cruickshank fined the 42-year old £600 plus £40 in a victim surcharge and ordered him to pay the complainer £200 in compensation.

The court heard how police had received numerous calls from annoyed neighbours complaining about the level of noise in the morning of 11 June.

Procurator fiscal Duncan Mackenzie said the noise was such that the walls and windows at 16 Excelsior Place were shaking.

After a first warning failed to have the desired effects, police were called to the property for a second time 40 minutes later.

The fiscal told the court that the 21 year old was immediately aggressive when officers tried to seize the equipment. Williamson was arrested but pulled aways and struggled violently with both officers.

Defence solicitor Marc Dickson said his client has kept himself out of trouble since becoming a father.

He is in line of obtaining employment and wants to apologise to police and his neighbours, the solicitor said.

Lerwick Sheriff Court heard on Wednesday that Barry McCann’s abusive behaviour on 8 May was racially aggravated.

McCann, of High Street, Kilbirnie, became aggressive when staff at the bar at Sellaness Lodge refused to sell him any more drink.

Security staff were alerted but when the situation deteriorated police were called and the 46-year old was eventually arrested

Defence solicitor Terry Gallanagh told the court that the incident has had already direct consequences for his client in that he lost his employment in Shetland.

Sheriff Ian Cruickshank said that “given the nature of offence” he wanted to give a “meaningful fine”, adding that there will be stiff fines for visiting workers if they don’t behave appropriately.
