A MAN from Mid Yell who assaulted his ex-wife and breached a court order by repeatedly approaching her has been given jail time.
Appearing from custody at Lerwick Sheriff Court on Wednesday, Darren Robertson, of Clingra Park, Camb, will not need to return to prison as he has already served enough time behind bars on remand for breaching bail conditions.
However, he was placed under supervision for 12 months after previously admitting assaulting his ex-wife by grabbing her by the throat, pushing her and presenting a knife at her at a Yell address on 15 May.
Procurator fiscal Duncan Mackenzie told Lerwick Sheriff Court at a previous hearing that the 48 year old separated from his wife in 2014 after over two decades of marriage.
Defence agent Tommy Allan said his client’s drinking was a major reason behind the couple’s divorce and when sober, he realises the effects of his behaviour.
Robertson also breached bail conditions by approaching the woman at a Mid Yell address and at Cooke Aquaculture’s fish factory, where they are both employed, on 19 and 24 May, and again between 1 and 21 June.
Defence agent Allan said that his client had already spent one and a half months in custody in relation to the offences, which was the equivalent to a sentence of three months.
He added that they had continued their contact while Robertson was in custody.
Taking this into account, Sheriff Philip Mann gave the man a jail sentence of two months and backdated it to when Robertson was first placed into custody.
