Court / Court round-up 27 August

A MAN who was bailed less than a week ago has had a warrant issued for his arrest after failing to show up for court.

Thomas Drever appeared from custody at Lerwick Sheriff Court last Thursday for breaching a community payback order, and was told to return today (Wednesday) for his next appearance.

Honorary Sheriff Eric Peterson had questioned last week whether 27-year old Drever should be bailed.

However defence agent Tommy Allan persuaded him to release Drever, from Ladies Drive, after he agreed to show at court.

Allan said it was “clearly in his [Drever’s] interest” to turn up at court, adding: “The ball is in his court”.

Today, Allan said he had “no explanation for his absence”.

Drever was placed under supervision for one year and handed 80 hours of unpaid work in May of this year.

That came after he behaved in a threatening or abusive manner towards police during an incident on 27 October last year.

He also previously pleaded guilty to a cocaine possession charge, with the value of the drug between £70 and £100.

Sheriff Ian Cruickshank issued a warrant for Drever’s arrest.

A CROFTER who threatened, shouted and swore at his neighbour has been fined at Lerwick Sheriff Court.

Ogilvy Brown, who is 78, approached his neighbour while brandishing his walking stick and making threats towards him on 22 April this year.

The court heard there was an ongoing dispute between the pair, stretching back years, in Mid Yell.

Brown went over to his neighbour while brandishing his walking stick, and when the complainer started recording Brown on his mobile phone he lost his temper further.

At one point Brown ordered the man to “put that away or I’ll smack you in the head”.

During the exchange he continued to shout, swear and threaten the complainer, as well as hitting his fence with his walking stick.

The complainer also thought that at one point Brown was going to strike his vehicle with the walking stick.

Defence agent Tommy Allan said there had been a number of disputes between the pair over the years.

He said Brown was in the process of trying to give up the croft and retiring.

Sheriff Ian Cruickshank fined Brown £500.

A THIRTY eight year old man has been bailed after being charged with a string of offences.

Henry Wishart, whose address was given as Shetland, appeared in private at Lerwick Sheriff Court on Wednesday.

He has been charged with three counts of assault to injury, two counts of assault, one charge of abusive behaviour towards a partner or ex-partner and causing an animal unnecessary suffering.

Wishart made no plea to any of the charges and was released on bail. No date was given for his next appearance.

A BIXTER man who assaulted two police constables during an incident in April has been ordered to pay money to the restitution fund for victims of attacks on police.

Daniel Euan, 33, appeared at Lerwick Sheriff Court to admit to the assaults, and to behaving in a threatening or abusive manner in a police van and at Gilbert Bain Hospital.

Police attended Euan’s home address at the request of paramedics on 12 April 2025 because they were concerned for his wellbeing.

Procurator fiscal Duncan Mackenzie said Euan was drunk at the time, and though police tried to reason with him “that proved impossible”.

He assaulted one police constable by pushing them on the body and butting them, before being put to the ground.

Euan assaulted the other police constable by spitting at them.

He was placed in the police van but his behaviour continued, with Euan striking his head against the cell compartment.

At the hospital he was shouting and swearing and creating a “fair degree of disturbance”.

Defence agent Tommy Allan said Euan had a “very good report” from social work, and that they had even said they did not think supervision was required.

Sheriff Ian Cruickshank agreed supervision was not required, but ordered Euan to carry out 100 hours of unpaid work within the next nine months.

In relation to the two police assaults, he ordered Euan to pay £500 to the restitution fund for victims of assaults on police.

A DRIVER found to be eight times over the limit for a cocaine metabolite has been banned from the road.

Shaun Hurson had 424 microgrammes of benzoylecgonine per litre of blood when stopped by police on Lerwick’s Kantersted Road on 31 January this year, with the limit being 50 microgrammes.

Benzoylecgonine is a chemical compound produced when cocaine is metabolized in the body.

Lerwick Sheriff Court heard the 33-year old was stopped at around 9.40pm, and produced a positive drug swipe when tested by police.

Hurson, from Brae, represented himself and pleaded guilty to the charge.

He said he had suffered from health complications since, requiring open heart surgery, and that his life had now “completely changed for the better”.

Sheriff Ian Cruickshank said this was a “high reading”, but admitted there was a marked difference between benzoylecgonine readings and alcohol readings.

He fined Hurson £500 and banned him from owning or obtaining a licence for 12 months.
