News / Sheriff asks for psychiatric report
SENTENCE on a young Shetland man with three convictions for hate crimes has been deferred for six weeks for a psychiatric report.
When appearing from custody before Lerwick Sheriff Court on Wednesday, Owen Finbar Haughian pled guilty to a charge of behaving in a threatening and abusive manner when he called a barmaid in the Lerwick Legion a “fucking Paki”, on Monday. The offence was committed while on bail.
The 29 year old had previously pled guilty to two similar charges, committed on 20 July, for which he was due to appear for sentencing on Wednesday.
Procurator fiscal Duncan Mackenzie said Haughian, of 18 Runnadale, Ollaberry, appears to harbour some deep seated prejudices which only surface when drunk.
Mr Mackenzie added that committing yet another offence while out on bail bordered on “stupidity almost beyond belief”. And he asked: “Is there something else?”
Sheriff Philip Mann said that Haughian’s offending had now come to a point that he had to consider a custodial sentence, but added that he wanted to investigate his mental condition first.
He deferred sentence until 3 October for a psychiatric report, released Hauhian on bail but put him under curfew for seven days a week between 9pm and 5am.
Haughian was also told that until early October he is not allowed to enter any licensed premises apart from shops and supermarkets, and was not allowed to be under the influence of alcohol in a public place.
