News / Drunk men tied up angry woman

TWO East European men working in Shetland who tied up a woman because she was angry with them drinking were warned to be of good behaviour at Lerwick Sheriff Court on Thursday.

Agris Kezbers, aged 38, of 29 Cheyne Crescent, Lerwick, and his 36 year old friend Juris Lapcenoks, of 1 Skerpalea, Sandwick, both admitted assaulting the woman on 13 December.

The court heard how the pair had been drinking heavily at a house in Cunningsburgh and the woman, also from eastern Europe, was not happy with their condition.

Procurator fiscal Duncan Mackenzie said that in the past she had expressed her disapproval “in fairly robust terms”.

To pre-empt her doing so again, they dragged her into the bedroom and tied her wrists and legs together with adhesive tape, before leaving the house. She managed to break free without great difficulty and called the police.

“They thought it was funny, the complainer didn’t,” Mr Mackenzie said.

He added: “On the face of the complaint it may appear quite a sinister act, but it’s clearly more an act of drunken stupidity and failing to take account of the effect of their actions on the complainer.”

Lapcenoks’ defence agent Tommy Allan said all three had been drinking and the woman had become quite angry.

He said that the fish factory worker had helped his friend tie her up to stop her causing herself or either of them any harm, adding that he was worried about how he would escape the building and that in the past he had called the police because of her temper.

Colin Neilson, acting for Kezbers, said what had started off as high jinx had got out of hand.

Sheriff Philip Mann deferred sentence on the two men for six months for them to be of good behaviour, saying he accepted the case was not as sinister as it appeared.

He said: “I suppose it comes as no surprise to me that the complainer, whatever her nationality, is no different from your average Scottish woman when it comes to exhibiting disapproval of their men when they are overindulgent in drink.”
