News / Jail likely for unprovoked assault
A LERWICK man has been warned he could face jail after he stubbed his cigarette out in a man’s eye on a drunken night out in the town.
Lerwick Sheriff Court on Wednesday heard that a couple had been walking up Lerwick’s Fox Lane outside Posers nightclub as people left the club on 7 May, when they heard someone make a racist comment about a friend they were with.
Procurator fiscal Duncan Mackenzie said the man had responded and that would have been the end of the matter, however 31 year old Trevor Tulloch, of 7 St Sunniva Street, suddenly intervened and started shouting and swearing at them.
Mr Mackenzie said they tried to calm Tulloch down, but instead he stubbed his cigarette out in the man’s eye. He was treated in hospital, but was not seriously injured.
On Wednesday Tulloch pled guilty to causing fear and alarm and assaulting the man to his injury.
Defence agent Tommy Allan said his client had been too drunk to remember what had happened, and was “absolutely horrified” that he had acted in this way.
As a result he had “taken a long hard look at himself”, and had taken steps off his own back to seek help with his drinking.
Sheriff Graeme Napier deferred sentence for two weeks for a social enquiry report, but warned Tulloch that with his criminal record the most likely outcome was a jail sentence.
