Court / Man fined after breaking bail conditions on same day of release

Lerwick Sheriff Court.

A MAN with a bail address in North Yorkshire has been fined after admitting breaking bail conditions immediately after were imposed yesterday (Monday).

Sai Vishal Varma Saraswathi appeared from custody at Lerwick Sheriff Court on Tuesday.

The court heard that as part of an ongoing enquiry into a serious domestic matter the 26-year-old had been told not to approach or attempt to approach the complainer, and not to enter an address in Lerwick.

However Saraswathi was found at the address and with the complainer the same evening and subsequently arrested by police.

Representing Saraswathi via a poor telephone line, defence solicitor Tommy Allan said his client had “effectively” no one to turn to and also needed to contact his place of work.

Allan asked the court to grant bail as it was his client’s intention to leave the isles and head for Fort William for new employment.

He confirmed a bail address of Garnet Street in Middlesborough.

Honorary sheriff Willie Shannon adjourned court briefly to consider the case.

He told Saraswathi that breaching bail conditions was a serious matter but added that, on this occasion, he accepted that it had been a “genuine error”.

He fined him £100 plus £10 victim surcharge and reminded him that the original bail conditions remained in place.
